Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of cardmart210.com and every purchase, sale, or trade with CardMart210 (“CardMart210,” “we,” “us”), online or in person. By using the site, placing an order, or submitting a Buy/Sell/Trade request, you agree to these Terms, our Return Policy, and our Privacy Policy. If you do not agree, do not use the site or buy from us.

1. Eligibility and accounts

You must be at least 18 years old, or have a parent or guardian’s permission and supervision, to buy or sell. You are responsible for your account, your password, and all activity under your account. We may refuse service, cancel orders, or suspend or close any account at any time, for any reason, in our sole discretion.

2. Products and descriptions

  • Trading cards and sealed product are collectibles. Descriptions, conditions, and photos are provided in good faith, but minor variations in centering, color, print lines, surface, and edges are normal and are not defects.
  • Condition of ungraded cards is our good-faith opinion; our assessment controls. Graded cards are sold based on the grade assigned by the third-party grading company. We do not guarantee any grade, any future grade on resubmission or crossover, or the condition of the slab.
  • Sealed product is sold as sealed. Pack and box contents are random; we make no promise about what any sealed product contains.
  • Photos of sealed product may be stock or representative images.
  • Nothing on this site is investment advice. We make no promise about the current or future value of any item.

3. Prices, errors, and order acceptance

Prices, availability, and promotions may change at any time without notice. Your order is an offer to buy; it is accepted only when we ship it or hand it to you. We may limit quantities and may refuse or cancel any order, in whole or in part, at any time and for any reason, including pricing, photo, or description errors, inventory issues, or suspected fraud or resale abuse. If we cancel after you have been charged, our only obligation is to refund the amount paid for the cancelled item.

4. Payment and taxes

Payment is processed by our third-party payment processor (Stripe). You authorize us to charge the payment method you provide for the full order amount, including applicable sales tax and shipping. You agree to contact us to resolve any problem before disputing a charge with your bank or card issuer. If you file a chargeback that we successfully contest or that is found to be unwarranted, we may cancel pending orders, forfeit store credit, suspend you from future purchases, and seek recovery of the disputed amount plus related fees and costs to the extent permitted by law.

5. ALL SALES FINAL; DISCLAIMER OF WARRANTIES

ALL ITEMS ARE SOLD “AS IS” AND “WITH ALL FAULTS,” AND ALL SALES ARE FINAL. TO THE FULLEST EXTENT PERMITTED BY LAW, CARDMART210 DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. Any return, exchange, refund, or credit is at our sole discretion as described in our Return Policy.

6. Shipping, risk of loss, and local pickup

Shipping dates are estimates, not guarantees. Title to and risk of loss for shipped items pass to you when we deliver the package to the carrier. We are not responsible for carrier delays, loss, theft, or damage after that point, including packages the carrier marks as delivered; any claim must be made with the carrier, though we may assist in our discretion. For local pickup, title and risk pass to you at hand-off; you should inspect items at pickup, and taking the item confirms you accept it as is. Unclaimed pickup orders may be cancelled after 14 days, less any fees permitted by law.

7. Buy / Sell / Trade

  • Quotes and offers we give are estimates only and are not binding until we accept the items in person or after inspection. We may change or withdraw any offer, and may decline any item, at any time for any reason.
  • You represent that you own the items you sell or trade, that they are authentic, and that you have the right to sell them. We may refuse, retain, or report to authorities any item we believe is counterfeit, altered, or stolen, and we will not pay for such items.
  • Items you ship to us travel at your risk. Items we decline will be returned at your expense or made available for local pickup; items not claimed within 30 days of notice may be treated as abandoned to the extent permitted by law.
  • Store credit has no cash value, is non-transferable, cannot be exchanged for cash except where required by law, and is not replaceable if misused.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CARDMART210 AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST VALUE, OR LOST OPPORTUNITY, ARISING FROM THE SITE, ANY ITEM, OR THESE TERMS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE ITEM GIVING RISE TO THE CLAIM.

9. Indemnity

You agree to defend, indemnify, and hold harmless CardMart210 and its owners, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the site, your breach of these Terms, any item you sell or trade to us, or your violation of any law or third-party right.

10. Disputes, arbitration, and class action waiver

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms, the site, or any purchase, sale, or trade will be resolved by binding individual arbitration administered in Bexar County, Texas, except that either party may bring an individual claim in small claims court in Bexar County, Texas. You waive any right to a jury trial and to participate in a class, collective, or representative action. Any claim must be brought within one (1) year after it arises, or it is permanently barred, to the extent permitted by law. For any matter not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Bexar County, Texas.

11. Site content and trademarks

All site content, including our logo, photos, and text, belongs to CardMart210 or its licensors and may not be copied or used without our written permission. Pokémon, One Piece, Dragon Ball, Gundam, Lorcana, and other product names are trademarks of their respective owners; CardMart210 is an independent retailer and is not affiliated with or endorsed by them. The site is provided “as is” and may be unavailable or contain errors; we may change or discontinue any part of it at any time.

12. Changes and general terms

We may update these Terms at any time by posting the new version on this page; the version posted when you place an order applies to that order, and your continued use of the site means you accept the changes. These Terms, together with our Return Policy and Privacy Policy, are the entire agreement between you and us. If any provision is found unenforceable, it will be enforced to the maximum extent permissible and the rest will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them without restriction.

These Terms apply to the fullest extent permitted by law and do not limit any right you have that cannot be waived under applicable law.
